NOTICE PURSUANT TO: SECTION 177AE OF THE PLANNING AND DEVELOPMENT ACT 2000 (AS AMENDED) & THE PLANNING AND DEVELOPMENT REGULATIONS 2001 (AS AMENDED)

NOTICE OF PLANNING APPLICATION TO AN BORD PLEANÁLA FOR APPROVAL

In accordance with the provisions of Section 177AE of the Planning and Development Act 2000 (as amended) Louth County Council gives notice of its intention to carry out the following proposed development:

The Construction of 44 no. Houses including 3 no. two storey 4 bed, 10 no. two storey 3 bed, 21 no. two storey 2 bed and 10 no single storey 2 bed on a site of 1.5 ha in the townland of Point, at Lower Point Road, Dundalk, Co. Louth

The proposed development will also include the construction of a new access road onto Waterview; provision of a new public footpath, public lighting, new estate road, 47 no. car parking spaces including both in-curtilage and on street parking, cycle parking, hard and soft landscaping including public open spaces, and private gardens, boundary treatments, ESB substation, laying of underground sewers, watermains and pipes, attenuation, the importation of soil and stone as byproduct for engineering and landscaping purposes within the development and all associated works.

Louth County Council proposes to seek the approval of An Bord Pleanála for the proposed development under section 177AE of the Planning and Development Act 2000, as amended. A Natura Impact Statement (NIS) has been prepared in respect of the proposed development.

In accordance with Article 81A(5) of the Planning and Development Regulations 2001 as amended, Louth County Council has concluded from a preliminary examination pursuant to the provisions of article 120(1)(b)(i) of the Planning and Development Regulations 2001 as amended   that there is no real likelihood of significant effects on the environment arising from the proposed development and that an Environmental Impact Assessment is not required.

An Board Pleanála may give approval to the application for development with or without conditions or may refuse the application for development.

Plans and particulars of the housing development, including the Natura Impact Statement,  are available for inspection or purchase, at a fee not exceeding the reasonable cost of making a copy, at the offices of the Louth County Council as set out below and are available for inspection on the website of Louth County Council at https://consult.louthcoco.ie/  hereafter.

The plans and particulars, including the Natura Impact Statement, may also be inspected at the offices of An Bord Pleanála.

Submissions and observations may be made in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, before 5.30 pm on 9th July 2024 relating to:

i) The implications of the proposed development dealing with the proper planning and development of the area in which the development is concerned,

ii) The likely effects on the environment of the proposed development; and

iii) The likely significant effects of the proposed development on a European Site, if carried out.

A person may question the validity of any such decision by the Board by way an application for judicial review, under order 84 of the Rules of the Superior Courts (S.I. No. 15 of 1986), in accordance with section 50 of the Planning and Development Act, 2000, as amended.
